Terms of Service

Welcome to grAAAAde.com ("Service"), operated by Steve Kosbau ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Description of Service

grAAAAde.com is an AI-powered study assistant. Users upload course materials (PDFs, slides, notes, images), ask questions, and receive answers with Vancouver-style citations from their uploaded documents. The Service uses Anthropic's Claude AI models to analyze materials and generate responses.

2. Account Registration

You must provide a valid email address and create a password to use the Service. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately of any unauthorized use. You must be at least 13 years old to create an account.

3. Free Trial and Subscription

• Free Trial: New accounts receive a 7-day free trial with full access. No credit card is required for the trial.
• Subscription: After the free trial, continued use requires a paid subscription at $29.99 per month.
• Auto-Renewal: Subscriptions automatically renew each month. You will be charged on the same day each billing cycle.
• Cancellation: You may cancel at any time through the Stripe billing portal accessible from your account. Cancellation takes effect at the end of the current billing period.
• Refunds: No partial refunds are provided for unused portions of a billing period. If you cancel, you retain access through the end of the current paid period.

4. Payment Terms

All payments are processed securely through Stripe. We do not store your credit card information on our servers. By subscribing, you authorize us to charge your payment method on a recurring monthly basis. Failed payments may result in suspension of your account until payment is resolved.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You may NOT:

• Use the Service to commit academic dishonesty, including but not limited to submitting AI-generated answers as your own work in violation of your institution's academic integrity policies.
• Upload content you do not have the right to use or distribute.
• Attempt to circumvent the trial limit by creating multiple accounts.
• Reverse-engineer, decompile, or attempt to extract source code from the Service.
• Use the Service to harass, abuse, or harm others.
• Interfere with or disrupt the Service or its infrastructure.
• Share your account credentials with others.

We reserve the right to suspend or terminate accounts that violate these terms without notice or refund.

6. Intellectual Property

• Your Content: You retain ownership of all materials you upload. By uploading, you grant us a limited, non-exclusive license to process, analyze, and store your content solely for the purpose of providing the Service to you.
• Our Service: The Service, including its design, code, and AI integrations, is our intellectual property. You may not copy, modify, or distribute any part of the Service.

7. AI Accuracy Disclaimer

IMPORTANT: grAAAAde.com uses artificial intelligence to generate answers. AI-generated answers may contain errors, inaccuracies, or omissions. The Service is a study aid and is NOT a substitute for attending class, reading your materials, or doing your own work. We make no guarantees about the accuracy, completeness, or correctness of any answer provided. You are solely responsible for verifying all information before using it in any academic context. We are not responsible for any academic consequences, including but not limited to incorrect exam answers, poor grades, or academic integrity violations, resulting from reliance on the Service.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Indemnification

You agree to indemnify, defend, and hold harmless Steve Kosbau, grAAAAde.com, and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request deletion of your account and data at any time by contacting us.

12. Data Deletion

Upon account deletion, all your uploaded materials, questions, and associated data will be permanently removed from our systems. This action is irreversible. To request account deletion, contact us at support@graaade.com.

13. Modifications to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a notice within the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved exclusively in the state or federal courts located in the State of Michigan.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

16. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings.
